This is an action to recover $57.60 claimed to be due plaintiff from defendant for labor performed. The complaint alleged in general terms that “plaintiff performed work, labor and services for the defendant at his special instance and request, reasonably worth and of the value of $70, which sum the defendant agreed to pay therefor.” The answer alleged a contract of hiring by which plaintiff agreed to work for defendant for a period of four months at an agreed compensation of $120 for the entire period, and that plaintiff quit *305the employment long before the expiration of the period in…
