Petitioner Michael Toffler moves to "dismiss” a pending *704arbitration proceeding between himself and respondent Martin Pokorny.

Petitioner Toffler is a periodontist licensed to practice in New York State. Respondent Pokorny is a dentist licensed to practice in New York State. In September 1988, Toffler and Pokorny entered into a sublease wherein Toffler agreed to pay Pokorny a percentage of his gross receipts from patients in exchange for office space (three treatment rooms, supplies, equipment and staff).
