MEMORANDUM DECISION AND ORDER
KIMBALL, District Judge.
This matter is before the court on Defendants’ Motion to Dismiss, Plaintiffs’ Motion for Class Certification, and Plaintiffs’ Cross Motion for Partial Summary Judgment. A hearing on these motions was held June 19, 2003. Defendants Rod Betit et al. (“Defendants”) were represented by Joel A. Ferre, and Plaintiffs M.A.C. et al.
