Defendant Southern Orthopedic and Musculoskeletal Associates, PA. (“SOMA”) appeals from the trial court’s grant of plaintiff’s motion to stay arbitration and denial of defendant’s motion to compel arbitration and dismiss plaintiff’s complaint.
The record discloses that in the fall of 1997, plaintiff, an orthopedic surgeon in Chattanooga, Tennessee, interviewed for an employment position with Asheville Orthopedic Associates (“AOA”),1 a professional association comprised of four orthopedic surgeons.
