1Opinion of the CourtMackintosh, J.
—Charles Drury, during the time of
the occurrence of the incidents which form the foundation of this litigation, was chairman of the hoard of directors of the Scandinavian-American Bank of Tacoma, and in September, 1920, exchanged eighty shares which he owned of the capital stock of that bank for an apartment house owned by the appellant. This is a suit to rescind the transaction, and is founded upon the alleged misrepresentations and fraud of the respondents and their agents.
