This is a medical malpractice case. The defendant doctor appeals from an order granting a new trial following a jury verdict in his favor.

The action, brought by Paul S. and Mary Jane Holt on behalf of themselves and as guardian ad litem for their daughter, Janice Holt, arises out of the pre-natal care and delivery of the child on December 22, 1966, by the defendant obstetrician. Following the birth, it became apparent that the child was a spastic quadriplegic with brain damage and cerebral palsy.
