In August, 1918, the defendants, D. J. Rickies, L. M. Kempf and Earl McVicar, were co-partners, dealing in junk. During that month they sent the defendant Kempf to Alaska for the purpose of purchasing junk for the copartnership. In October, 1918, he had accumulated a considerable amount at St. Michael, in the territory of Alaska, and made arrangements with a steamship company to deliver it to Seattle for a certain compensation.
