Harold S. Hobson, plaintiff-appellee, brought this action against Cyrus S. Eaton and the Cleveland Trust Cq., in the United States District Court for the Northern District of Ohio. Eastern Division, for a declaratory judgment (Section 2201, Title *3028 U. S. Code) that he is the beneficial owner of certain claims against the estate of Frank H. Hobson. The deceased, Frank H.
