It will be difficult to discuss some of the questions presented for decision without first narrating many of the admitted facts and also much of the evidence relating to most of the controverted facts. Kerley had been engaged in the insurance and brokerage business in Pendleton, where he maintained an office. Kerley represented, among other insurance companies, the St. Paul Fire & Marine Insurance Company; and Fred Tebbin, who resided in Portland had the supervision of agents of that company, including Kerley.
