SUMMARY ORDER
Plaintiff, James C. Pacenza, Sr., commenced this action under the Americans with Disability Act of 1990 (“ADA”), the Age Discrimination in Employment Act of 1967 (“ADEA”), and the New York State Human Rights Law (“NYSHRL”). He alleges that Defendant (“IBM”) discriminated against him on the basis of his age and his disability when it terminated him. On April 2, 2009, the United States District Court for the Southern District of New York (Gardephe, J.) granted summary judgment to IBM and dismissed Plaintiffs claims in their entirety.
