This is an action for deceit in which the plaintiffs recovered a judgment for $2,000 and the defendants have appealed.
*258The action grows ont of the sale of a dwelling house in Oswego, Clackamas County, Oregon, by Arthur Tillen and his wife, the then owners, to the plaintiffs, and is based upon false representations relative to the construction of the house alleged to have been made by the defendants to the plaintiffs and upon which they relied and which induced them to make the purchase.
