In Equity. Suit hy J. M. Bryan and others against D. S. Barriger and others, begun in the state court and removed to the federal court. On plaintiff’s motion to remand, together with the motion of the named defendant to quash the service of summons.

[1] The plaintiffs have moved the court to' remand this action to the Simpson circuit court, in which it was commenced, upon the grounds, first, that the petition for its removal to this court was filed by defendant Barriger too late to entitle him to take that step; and, second, because, while it may be true that he is a citizen of New York, his codefendants are citizens of Kentucky, and are necessary parties to the action for the relief sought hy plaintiffs.
