Plaintiffs, Michael Scroggins and Catherine Russo, brought this action to recover damages for injuries allegedly incurred when they were struck by an automobile. Counts I through III of plaintiffs’ complaint named as defendants Anastasios Karabatsos, the driver of the vehicle, and Kyriakos Karabatsos, his father. Count IV of the complaint was directed against the individual defendants’ insurer, defendant Allstate Insurance Company (Allstate); it sought damages for Allstate’s allegedly wrongful refusal to negotiate in good faith…
