THIS CAUSE is before the Court on the Motion to Dismiss Amended Complaint (D.E.30), filed July 23, 2001, by Defendant David Thomas, and the Motion to Dismiss (D.E.35), filed July 31, 2001, by Defendant Lawrence D.
