OPINION
DAMICH, Chief Judge.
Before the Court are the Shareholder Plaintiffs’ motion for partial summary judgment on their taking claim and Defendant’s cross-motion for summary judgment as to the Plaintiffs’ taking claim. On April 12, 2002, the Court granted Defendant’s cross-motion as to takings with respect to the Federal Deposit Insurance Corporation (“FDIC”) and dismissed the FDIC from the consolidated proceedings.
