Reversing.

This suit was commenced in the Green circuit court hy appellee, Dulworth, against the J. I. Case Threshing Machine Company to -obtain a rescission of a contract of purchase of a farm tractor, and, if that could not he done, for judgment on a warranty for the price, $1,-217.92,'agreed upon to be paid for the tractor, the purchaser having executed his negotiable-note and it having-passed in due course of business to a banking institution.
