The Circuit Court sustained the demurrer of the appellee to the evidence of the appellant, who was the plaintiff below.
*522The action was begun before a justice of the peace, and was brought to recover a penalty for obstructing a highway, under section 24 of the act concerning supervisors, approved March 5th, 1859, 1 R. S. 1876, p. 860.
