— This was a complaint by the appellants, whoAvere citizens and taxpajmrs of Patoka township, Gibson county, to enjoin the collection of a tax which had been levied for the benefit of the Louisville, Neiv Albany and St. Louis Railroad Company. A demurrer Avas sustained to the first paragraph of the complaint. The demurrers of the appellees, the board of commissioners, and of Montgomery, the auditor, Avere sustained to the second paragraph.
