The plaintiff sought a declaratory-judgment as to the right of the defendant to sell alcoholic liquor under a restaurant beer permit issued by the liquor control commission to be operative upon premises located within five hundred feet of- a church, a use claimed to be contrary to the zoning ordinances of the plaintiff town, and for an injunction restraining that use.
