This is an action by the vendee of certain land and of certain shares of stock in an irrigation company to cancel the contract and to recover various sums paid to the vendor, and also the value of improvements placed upon the land. The suit is based upon an alleged rescission of the contract of sale, for failure of title and failure of the irrigation company to furnish the quantity of water required for irrigation. The defendant by answer contested the right and the fact of rescission, and by cross-bill sought a specific enforcement of the contract. The cause was tried by the court and…
