In this appeal, a group of hospitals challenge the trial court’s grant of summary judgment on the hospitals’ statutory claims for prompt-pay penalties in favor of a health maintenance organization, or HMO. Specifically, Christus Health Gulf Coast, Christus Health Southeast Texas, Gulf Coast Division, Inc., Memorial Hermann Hospital System, and Baptist Hospitals of Southeast Texas (collectively, the “hospitals”) contend Aetna Health, Inc., an HMO, and its parent company, Aetna, Inc.
