This cause was originally filed in the district court of Custer county by Carroll, Brough, Robinson & Humphrey against the Chicago, Rock Island & Pacific Railway Company, and the St. Louis & San Francisco Railway Company, and on motion of plaintiff was transferred from the district court to the superior court of Custer county.
