These are appeals in two criminal cases. The indictment in Number 13833 in the United States Court for Colorado contained two counts. It was charged in the first count that Eugene Smaldone, also known as Checkers Smaldone, Clyde George Smaldone, also known as “Flip Flop” Smaldone, Fiore Smaldone, Louis F. Smaldone, William Calvaresi, Jerry Bennallo, Jr., Michael J. Benallo, and Joseph F.
