Appellant, cross-appellee, C.A. Over-street (“Overstreet”) appeals from the district court’s judgment for appellee, cross-appellant, Loffland Brothers Company (“Loffland”), in an action to collect corporate funds advanced to the former employee under Loffland’s Deferred Compensation Plan, ‘Stimulate the Earnings Plan’ (“STEP” or “Plan”). Overstreet also challenges the forfeiture of his accumulated benefits in the plan. Loffland appeals the denial of pre-judgment interest on the promissory notes executed by Overstreet.
