WOLVERTON, District Judge.
This writ is from a judgment obtained by the defendant in error against the plaintiff in error on account of personal injuries received while in the latter’s employ. The case was commenced in the state court, and on petition of the defendant in the original cause was removed to the Circuit Court of the United State for the Western District of Washington. The defendant was engaged in construction work which required the use of a pile driver.
