This is an action under the Federal Employers' Liability Act to recover for the death of plaintiff's husband, a conductor, who was run over and killed in defendant's yards in East Alton, Illinois. The verdict was for defendant and plaintiff appealed. We heretofore ruled that plaintiff, under the facts, failed to make a submissible case and affirmed [337] the judgment below. [Seago v. New York Central R.
