OPINION OF THE COURT

FULTON, Senior Judge:

A general court-martial convicted the appellant, Specialist Yoakum, of aggravated assault and willfully damaging private property.

The events leading to his trial occurred at Redstone Arsenal, Alabama, in the early morning hours of 2 February 1978, when the Noncommissioned Officers Club closed. As the patrons left for the night, two of them, Specialist Yoakum and his girlfriend, Linda, engaged in a heated argument on the steps adjacent to the driveway and parking lot.
