THIS MATTER is before the court on Defendant’s Motion For Summary Judgment and/or Dismissal (Doe. 27) and supporting memorandum of law (Doc. 28). Plaintiff filed a response in opposition (Doc. 36). By its motion, Defendant seeks summary judgment on Plaintiff’s claims of disability discrimination brought pursuant to the Americans with Disabilities Act of 1990 (hereinafter “ADA”), 42 U.S.C. §§ 12112, et seq., and 42 U.S.C. §§ 2000e, et seq.
