ORDER
LAZZARA, District Judge.
Before the Court is Defendant’s Motion to Dismiss Count II of Plaintiffs Complaint (Dkt.4) and Plaintiffs Response (Dkt.5). Defendant asserts that count II is time-barred. Based on this record and the applicable law, the Court is of the opinion that the motion should be granted.
