OPINION AND ORDER GRANTING SUMMARY JUDGMENT
HILL, District Judge.
In this action, Plaintiff, Aluminum Extrusion Company, claims that Defendant, Soule Steel Company, infringed a patent for a type of window construction and seeks damages and an injunction against future infringement.
Defendant now moves under Civil Rule 56 for summary judgment. The affidavits filed in support of the motion disclose that there is no genuine issue as to any material fact relating to the issue of infringement.
