In August 1974 the Mining Enforcement and Safety Administration, the enforcement branch of the Secretary of the Interi- or, alleged that Old Ben Coal Company (hereinafter “Old Ben”) had committed numerous violations of the Federal Coal Mine Health and Safety Act of 1969 (hereinafter “Coal Act”), 30 U.S.C. §§ 801 et seq. (1976 ed). After a hearing the administrative law judge issued a decision on June 23,1975 that assessed Old Ben civil penalties of $4200 for sixteen violations of the Coal Act.
