BAUER, Chief Judge.

The National Labor Relations Board (“NLRB” or “the Board”) sued the State of Illinois Department of Employment Security (“IDES”) for violations of Section 8 of the National Labor Relations Act (“NLRA” or “the Act”), 29 U.S.C. § 158. The NLRB claims that Section 900D of the Illinois Unemployment Insurance Act, Ill.Rev. Stat., ch. 48, para. 490 D (1989) (“Section 900 D”), is preempted by the NLRB’s ex-elusive jurisdiction to remedy unfair labor practices as prescribed in the NLRA.
