BISHOP, J.
In this declaratory judgment action, the defendant W. R. Berkley Corporation1 appeals from the judgment of the trial court, rendered in favor of the plaintiff, Trenwick America Reinsurance Corporation. *744On appeal, the defendant claims that the court improperly (1) concluded that there was no mutual mistake and (2) found that the commutation agreement was not ambiguous. The plaintiff cross appeals, claiming that the court improperly (1) concluded that there was no unjust enrichment and (2) denied its motion for attorney’s fees. We affirm the judgment of the trial court.
