Jeffrey A. Catalano (Catalano) appeals from an Order of the Elk County Court of Common Pleas (trial court) denying his *272Motion for a New Trial limited to the question of damages after a jury rendered a verdict in his favor in his suit against David M. Bujak (Bujak), a police officer, for personal injuries.

On the evening of December 6, 1986, Bujak, a police officer for Benzinger Township, Elk County, observed a car travelling 89 miles an hour in a 55 mile per hour zone. Bujak pulled the car over and asked the driver, Catalano, to step out of the car. Bujak suspected that…
