Before the Court are a Motion for Partial Summary Judgment (Rec.Doc. 49) filed by Plaintiff, Darryl Parker, and a Motion for Summary Judgment (Rec. Doc.50) filed by defendants Trinity Catering, Inc. (“Trinity”), Jackup Boat Service, LLC (“Jackup”), and Elevating Boats, LLC (“Elevating Boats”). Both motions are opposed. The motions, set for hearing on November 14, 2007, are before the Court on the briefs without oral argument.
