Plaintiff Mary Bakos appeals from a judgment on the pleadings in favor of defendant Flint Housing Commission (FHC). This case arises under Section 8 of the United States Housing Act of 1937, as amended by the Housing and Community Development Act of 1974. The district court held that a recipient of Section 8 benefits who wishes to move from one subsidized tenancy to another in the same area may be denied a Certificate of Family Participation by a local public housing agency if the recipient owes the agency back rent in connection with a previous non-Section 8 tenancy.
