This is an appeal prosecuted by writ of error from a judgment rendered in a.suit filed November 3, 1921, by defendant in error, in which he sought to recover damages against plaintiff in error for the alleged negligent building of a fire by plaintiff in error near a garage situated on property owned by defendant in error, which resulted, according to the allegations, in the destruction by fire of said garage. It was alleged that the garage at the time of its destruction was of the value of $1,200 and that the fire in question occurred on February 20th, 1921. The answer of plaintiff in error…
