One Peter B. Dirks was the managing officer of the Dirks- Trust & Title ‘Company, hereinafter denominated the Title Company, of .which corporation one AVilliam R. Tapper, a resident of Chicago, was also a stockholder. Among the enterprises in which Dirks wa,s engaged was the loaning- of money on notes secured by chattel mortgages on cattle and horses — such notes and mortgages being .commonly spoken of as “cattle paper.” His custom was- to take such paper, either in -his own name as payee or in that of the Title Company, and then sell *478same to loan, companies or capitalists.
