Victoria Studier, administrator of the estate of Virginia Moriana and personal representative of her next of kin, appeals judgment on the pleadings in favor of Benjamin Tancinco, M.D. (“the pathologist”) and Southwest General Hospital (“the hospital”). Studier brought survival actions for medical malpractice and wrongful death against six medical defendants. After the entry of certain settlements, dismissals and amended complaints not the subject of this appeal, only claims for spoliation or destruction of evidence against the pathologist and hospital remained at issue.…
