The plaintiff Niedermeyer, Inc., was in the possession of a fund, which, according to the opinions of the supreme court, it was its duty to return to the parties entitled thereto. To* this fund numerous conflicting claims were being asserted, and it was impossible for plaintiff to determine with’ safety, to whom this money should be paid.
