This is an appeal from an order of the Supreme Court at Special Term, entered August 30, 1966 in *265Washington County, which granted defendant’s motion pursuant to CPLR 3211 (subd. [a], par. 7) and dismissed the complaint for failure to state a cause of action.
The complaint alleges that on January 19,1966 plaintiff, Mary Lou Cox, was injured when the automobile she was operating collided with an automobile owned and operated by Robert 0. Du Chaine.
