In this civil action, plaintiff Richard Robinson (“Robinson”) is seeking to recover benefits under his employer’s long term disability plan which was insured by defendant Phoenix Home Life Mutual Insurance Company (“Phoenix”). Suit has been brought under the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. § 1001, et. seq.
