MEMORANDUM OPINION

HARVEY, Senior District Judge.

In this civil action, plaintiff Roscoe Dunbar, Jr. (“Dunbar”) is seeking to recover benefits under his employer’s disability plan which was insured by defendant Liberty Life Assurance Company of Boston (“Liberty Life”). Suit has been brought under the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. § 1001, et. seq. In a claim filed with defendant Liberty Life, plaintiff asserted that he had become totally disabled during the period of his employment with Orbital Sciences Corporation (“Orbital”), and he applied first for…
