The defendant was tried and convicted upon an information charging the defendant with the commission of a felony, to wit: that on or about the eighth day of October, 1925, etc., the defendant did wilfully, unlawfully, and feloniously have and accomplish an act of sexual intercourse with and upon a certain named female of the age of fifteen years and not the wife of the defendant, the information being based upon and charging the offense specified in subdivision 1 of section 261 of the Penal Code.
