MEMORANDUM OPINION AND ORDER

THIS MATTER comes before the Court on Defendant Friedman, Billings, Ramsey & Co., Inc’s Motion for a Status Conference Prior to Filing Any Answer or Rule 12 Motion, filed August 27, 2008 (Doc. 82). The Court held a hearing on September 15, 2008. At the hearing, the Court informed the parties that it would treat the hearing as the status conference Defendant Friedman, Billings, Ramsey & Co., Inc (“FBR”) requested and rule on the merits of the issue raised.
