In this interlocutory appeal, Eldridge Wyatt, an officer with the Oklahoma City Police Department, seeks review of a Magistrate Judge’s denial of his motion for summary judgment based on his qualified immunity from suit. Officer Wyatt contends the trial court erred in finding his alleged conduct violated clearly established law. Even if this court affirms the trial court’s denial of his motion for summary judgment, Officer Wyatt maintains he must be permitted to raise the issue of qualified immunity during trial.
