This is an action for benefits under the Employee Retirement Income Security Act, 29 U.S.C. § § 1001, et seq. (“ERISA”), for compensation on account of an alleged failure to provide notice of continuation of medical plan coverage under the Consolidated Omnibus Budget Reconciliation Act, 29 U.S.C.A. §§ 1161 et seq.
