delivered the opinion of the court.

The plaintiff, William McLaren, as administrator of the estate of William W. McLaren, brings this appeal from a judgment entered in the circuit court on the verdict of a jury, finding the defendant F. Byrd Incorporated, not guilty, and assessing costs against plaintiff.

The suit was brought to recover alleged damages for injuries which resulted in the death of plaintiff’s intestate and which was caused by the negligence of the defendant in permitting its truck with trailer attached to stand on an open highway in the nighttime…
