The plaintiff, Chase Manhattan Bank/City Trust (Chase Manhattan), brought this action against the defendant, AECO Elevator Company, Inc., for reimbursement of workers’ compensation payments *607made to John R. Huggins. Huggins, an employee of Chase Manhattan, was injured when he fell while stepping into an elevator installed and maintained by the defendant. Huggins intervened in the action as a coplaintiff seeking damages based on negligence.
