This action was originally instituted in the Circuit Court of Logan County, W'est Virginia, by the plaintiff to recover from the Appalachian Elecric Power Company damages for the death of Jack Crum resulting from alleged negligence of the defendant. On petition of the defendant the case was removed into this court on the ground of diversity of citizenship, the plaintiff being a resident of West Virginia, and the defendant a Virginia corporation.
